Having carried out many technology audits and due diligence investigations for purposes of licensing, avoiding infringement, advising investors, or for disposal or acquisition of IPR or companies, we are well placed to advise individuals or companies. Working through our network of trusted Attorneys in other countries throughout the world, we can advise on most IPR matters almost anywhere throughout the world.

 Validity and Infringement opinions

We conduct investigations into the validity of one's own patents ahead of seeking to licence potential licensees or enforce patents against others.  Also we carry out validity and infringement investigations to asses the risk of infringing IPR owned by others. also such investigations are essential if one is trying to exploit one's patents by way of licensing. Nothing can be more embarrassing than to approach a potential licensee only to find that they have a controlling patent that prevents you from licensing them or any one else. As one would expect, such opinions are given on the basis of the latest and up-to-date changes in the law or interpretations by the British Courts.

Working through our network of foreign Attorneys  where appropriate, we can provide opinions and advice in respect of IPR in other countries.

Due Diligence

A Due Diligence investigation entails a careful study of an existing intellectual property portfolio and identifies the extent and strengths and weaknesses of the portfolio. To effect such investigations requires a good understanding of the technology involved.  A detailed search for any conflicting IPR that could cause problems is carried out during such investigations where appropriate. Also an examination of competitors' IPR is carried out to assess freedom to use current or future technology, and strategies are discussed to achieve a desired conclusion if possible.  This is particularly useful and necessary when acquiring technology or acquiring companies, or when floating a company on the stock exchange.

So often individuals or start up companies launch a product on the market without first finding out who their competitors are, and whether there is any patent, Trade Mark or Registered Design owned by someone else that the would effectively stop them dead in their tracks. We carry out independent investigations on prior published patents and identify possible competitors (or potential licensees) and possible threats, and advise on strategies to circumvent or overcome problems if possible before they become a reality.

IPR Audits

An IPR audit entails a careful study of a client's existing intellectual property portfolio (if any), and an examination of competitors' IPR to assess freedom to use current or future technology, and the risks of infringing third party rights (if any).

An IPR audit will also explore areas of technology that the client may be working with and can identify technology that currently is not protected by patents, Registered Designs, and Trade Marks but may be capable of such protection. An audit will recommend what needs to be done to protect future IPR and will put into place procedures for ensuring that the maximum protection is obtained when new ideas are created.
